S.O.S. Romania party notified the Constitutional Court (CCR) on the expiration of the mandate of President Klaus Iohannis.
"On the basis of art. 146 letter g) of the Constitution, we request that you ascertain the existence of the circumstances that justify the interim exercise of the office of President of Romania, to ascertain the vacancy of the office, by the expiration, on December 21, 2024, of the mandate of the former President Klaus Werner Iohannis and to communicate the findings to the Romanian Parliament, with a view to appointing the acting president", reads the notification of the S.O.S. Romania sent on Tuesday to AGERPRES.
According to the cited source, "the mandate begins on the date of the oath taking by the person elected to this position and not from the moment of election and ends when exactly five years have passed from the date of taking the oath", Agerpres informs."According to art. 81 (4) of the Constitution, "no person can fulfill the position of president of Romania for a maximum of two mandates. These can also be successive". This means, as the same author says, that the fundamental law "establishes the rule according to which no person can hold the position of president of Romania for more than two mandates, which can also be successive. Therefore, regardless of the situation, a person cannot exercise more than two mandates as president. The rule is of strict interpretation and does not leave the possibility of choice. The current president has exercised the two mandates until December 21, 2024, midnight. (...) Remaining even one more day as president of Romania means starting a third mandate, which the Constitution does not allow", shows the notification of S.O.S. Romania, which is signed by the president of the party, Diana Iovanovici Sosoaca.
S.O.S. Romania also wrote letters to the presidents of the Senate and the Chamber of Deputies, requesting them to notify the CCR on the same subject.
